Employment

(Querist) 21 June 2013 This query is : Resolved
I WANT TO KNOW ABOUT THE REMEDIES AVAILABLE FOR AN EMPLOYEE WHEN EMPLOYER [A BIG ORGANISATION] BREACHES THE EMPLOYMENT CONTRACT BETWEEN THEM. ALSO THE COMPANY IS TRYING TO COMPEL THE EMPLOYEE TO SIGN A KIND OF BOND WHICH IS NOT IN FAVOR OR INTEREST OF THE EMPLOYEE.
prabhakar singh (Expert) 21 June 2013
SUIT IS THE REMEDY UNLESS EMPLOYEE IS PROTECTED BY SOME LABOR LAW.
Adv. Shagufta (Querist) 21 June 2013
ALSO CAN A COMPANY COMPEL AN EMPLOYEE TO PAY THE DEBT MORE THAN THAT IS AGREED IN THE EMPLOYMENT CONTRACT, ON EXIT.
prabhakar singh (Expert) 21 June 2013
NONE CAN COMPEL ME TO PAY ANY THING I DO NOT WANT TO PAY UNLESS A COURT DECREE IS PASSED AGAINST ME.

RIGHT?
Rajendra K Goyal (Expert) 22 June 2013
If the Bond is to be signed as precondition of the service, it should be refused for not acceptable terms. If possible try to change the job. Generally companies get signed such bonds so that they can squeeze employees in future.

No company can asked more money than accepted in agreed terms.

In case of non agreement by the company suit is way as suggested by the expert Singh ji.
