D/fellows, I am to apply for conviction suspension in the Distt Sessions Judge.Previuosly One of my friends applied for the same and it was dismissed on the ground that "This court ie Sessions Judge has no power to suspend the conviction." Is there some Law/Rule that above matter is out of purview of the Sessions Judge? with regards sanjeev kr

Why do not you file revision in The High Court only? It has ample power to suspend sentence.

Sessions Judge can also suspend conviction pending the appeal/revision thereto. You can search the relevant citations on indiankanoon.

Why do you presume anything negative, merely on the ground that your friends case was dismissed. If your application provides some sound presentation and relevant citations, you can hope positive results even from the Sessions Judge. Else, you may consider filing an appeal/revision, as suggested by the experts,
