Money suit

I had filed a money suit against one state bank employ .At E.P.stage the employ was absent from bank so the court send summons to the bank manager and also to the respondent . The notice to the bank manager was served But not to the respondent.The banks advocate informed the court that the respont have passed away last week . The only legal heir is his wife but do not know where about the wife .No summons can be servied on her. Now at this stage can I claim for the money due to him from the bank on his death. please reply so because the case is due for hearing on 30th jan 2013
I had also filed 138ni against him what will happen to that case

you may ask the address of the leag heirs from the bank itself or summon the bank to produce the records of the location of the respondent

You can get order against the bank or against any person who is having valid dues payable to the Judgment debtor. but the PF or pension LIC payment or some other funds could not be attached.
