Selling after taking possession without registering the flat

(Querist) 24 December 2012 This query is : Resolved 
We have a flat in greater noida against which we have taken possession in July 2012, however the registry for the same has not started yet. However due to finanacial issue i need to sell this flat. Builder has agreed that they can endorse and transfer the same to new buyer, if he is taking home load the same amount will go to builder and then builder will refund us. he will charge us transfer charges for the same.

Kindly confirm if same is ok

You should enter into a fresh Agreement for re-selling the said flat by the builder for refund your money.After taking the entire amount you should vacate the possession otherwise not.Engage a lawyer to see overall process.
