Deficit stamp duty act of ap

(Querist) 02 July 2012 This query is : Resolved 
sir,
party X has excuted the registered sale deed in favour of Y in the year of 1983. but, when the sale deed excuted Y has paid the deficit amount of stamp duty and after that The Rvenue Divisional Officer send a notice to the party Y to pay the deficit amount of stamp duty in the year of 1984, but Y has neither paid the stamp duty nor go to any appeal against the notice issued by the RDO till the year of 2010. when the dispute raised in that land of registered the party Y paid the deficit amount in the year 2010. According to AP stamps prevention act if the deficit amount of stamp duty not recovered from the party then the document have to be destroyed after 5 years of the collector's notice.
In this case either party X will get back his right on the land which was registered under under value registration after 5 years of the RDO's notice(Order). I am requesting the Honorable lawyers to give me the suggestion in this case.

no you wont get back right on land already sold by you . X has already sold the property by sale deed .

y wont get clear title to the property .
