Society transfer fees on sale within family

(Querist) 06 June 2012 This query is : Resolved 
Dear Sir,

My husband has purchased an property from his father. Both Parties had entered into a proper sales deed for the transfer of right of the immovable property. We have also paid the necessary Stamp duty and registeration.
In such a scenario, can the Society charge us the transfer fee for transferring the name.

Please advice.

no in case of inter family transfer no transfer charges are leviable

It is the duty of the managing committee to point out if there is a section which says that such transfer is chargeable

refer the bye law. Society acts in accordance with itz bye law.

Does a society have its own by-laws. or do they have to follow the by-laws introduced by the Maharashtra Co-op hsg society
