Sepration of case by one accused out of total six

hello all respected experts ,
A case with section 392/342/323/34 with 6 accused is pending in Chief judicial magistrate court from may 2009 ....no chargesheet have been given to any accused (as all accused have not present on any one common day )
main accused is absconding and cjm court issued warrant against him in aug 2011?

other accused excluding only one havent even attended since the day they got bail ..
that same accused had faced many rejections in govt service due to this police case and that same accused want to seprate his case n want to get the trial start ....n get a seprate judgement ? so please help is there any provision of case sepration and trial and whether he can get judgment ?

I presume that you must be talking about the charge and not the chargesheet. It is the right of the accused to get the copy of the chargesheet, once it is filed in the court.

You can insist the megistrate to split the case as the other accused are absconding.
