(Querist) 15 April 2012 This query is : Resolved
Can a new evidence/supporting document to prove experience can be submitted in review petition filed in High court.
Devajyoti Barman (Expert) 15 April 2012
No new evidence can be taken into account in Review petition.
However in Revision the court may taken into account the subsequent development which goes to the root of the case.
Sudhir Kumar, Advocate (Expert) 15 April 2012
what do you mean?
Raj Kumar Makkad (Expert) 15 April 2012
Such new facts may be brought before High Court by way of a separate head like subsequent events or additional pleas etc.
prabhakar singh (Expert) 15 April 2012
In any review petition filed in any court NO NEW MATTERIAL OF ANY KIND CAN BE TAKEN ON RECORD.The petitioner seeking the review has to prove that there is an error apparent on face of record already before the court which the court has either overlooked to consider or has misread the same while drawing its conclusion while true conclusions are otherwise on a cool examination of those.
Raj Kumar Makkad (Expert) 15 April 2012
What I want to prove that no new facts can be brought while replying to the earlier order on merit but if any subsequent event has occurred then can only be brought to the knowledge of High Court so that it may be taken into consideration though still it is the discretion of the court whether to take it in its consideration or not but there is no harm in putting the important event.
