Regarding fir copy

(Querist) 09 April 2012 This query is : Resolved 
I have file money suit against one person for loss due to negligent driving & accident. For that Driver of Opposite party had lodge a FIR in police station near udaipur. Now we want to get certifide copy of F.I.R for proving accident . But police dept. does not give copy and told me that only person who had lodge a F.I.R. has a right to get copy. What can i do ?. I have also sent application for certifide copy vide Registered A.D. but return it with remarks that "party not accepted". Pls. guide me.

you should send a RTI application with the fee to SSP and you can get all the documents in this regard

If the FIR is against you, then you are entitled for a copy of FIR.

If the case have reached the court, then you can get a copy from the court too.

The police cannot deny giving an FIR copy to the defendent or the accused.

FIR is a public document, any body can obtain the copy of the same from the concerned PS.
