A wife along with her 7 children filed a suit for partition and separate possession of their 1/9th share against her own husband defendant No: 1 ? contending that plaintiffs and defendant No: 1 are the members of Joint Hindu Family. Plaintiffs further challenged the sale deed made by defendant No: 1 in favour of defendant No: 2 that too after lapse of 26 years as the sale deed in not binding upon their share.

Is it such a suit is maintenable ? can they challange the sale deed as not binding upon thier share ?

TO MY CONSIENCE IT STRIKE NOT ILLEGAL.SALE DEED MADE AND 26 YR PASSED SLEEPING OVER RIGHT TO SUE IS TO ME NOT ILLEGAL BUT IS,T IT A CASE OF LIM RUN OVER?
