Dear All,

Greetings!!

Please find the attached snapshot of High Court Lucknow Order.After receiving the same order on 9-2-12.The respondent university did not declare the required result.

1. What could be the strongest action against respondent university ?

2. What would be the grounds on which compensation would be calculated ?

File contempt petition before H.C.against university.

You can file a contempt of court proceeding against all the erring officials of the university but it shall be better for you to send a notice to the university prior to doing so which shall even become a reminder for the university to follow the verdict of high court.

The order is conditional, the compliance is of order based if there exist no legal impediment in compliance. Moreover, contempt is lie only when order is not complied. So further action can not be decided unless university takes any decision in compliance High Court's order.

I came to know there are two options I have -

1. I can send reminder.
2. I can file direct Contempt of Court.

Now according to few learned advocated I can send reminder.My doubt is.. if the university did not declare the results after :

1. Mmultiple application with official college letter.
2. RTI process.. now matter with State Information Commission.
3. The governor order in October 2012.
4. The HC order.

A. Is providing reminders will not be only wastage of time , 99% the outcome will not be zero ?


B. What are rooms for university in case of contempt of court ? Whats are the chances that they will bound to declare the required results ?

C. How they can save them from legal proceedings against them ?

D. In the attached order, university lawyer submits no objection with the direction from HC. After this do they have room to put some explanation on the basis of legality of not to declared the asked results ?
