Dear sir / madam,
My name is R.hari from tamilnadu ( india ). Last 2001 year, my father gave one land to his own brother’s son by gift settlement. After that his activity is totally changed. His torturing to my family. And he fighter to my father and my elder brother. After that my father compliant the police station and made a FIR also ( This incident was 2003 ). Then one year he quiet, after one year again he fought.
That time my father not went to the police station. He went sub register office and canceled the above gift deed with FIR copy, (year of 2005). Now my father brother’s son files a case against of cancelled gift deed.
Question’s:
1. My father cancelled the gift deed is legally correct or not ?
2. If I save the above property what will do ?

Gift once given and accepted by donee is final and can never be cancelled. The case of your cousin brother is correct. Your father has wrongly cancelled the gift deed.

If your father brother’s son accepted gift before cancellation, then you can't do nothing.

Answer: an illegal way.
2. If I save the above property what will do ?
Answer: unfortunately you can not save.
YOUR FATHER WAS REQUIRED TO FILE A SUIT OF CANCELLATION OF GIFT IN THE YEAR HE WENT TO REGISTRAR TO CANCEL THE GIFT UNILATERALLY.
