Gratuity and other fund

dear experts plz advise me on the service law there is an advocate in delhi who works for MCD(MUNICIPAL CORPORATION OF DELHI) WORKERS who got retired or expired on job.
according to him after getting the benefits after retirement/death there also remains some money with the department and he files the petition or application and get the further amt to the employee I m totally confused under which law he gets the amt.
plz help me in this matter.

You should have raised this query only from him rather raising it for all of us as we have lesser knowledge only to the extent that when we derive 100 out of 100, the result comes to ZERO and nothing remains there but if you have found a lawyer who can again make the result to 25 or 50 then share with his tricks.

if as per the service rules of MCD all the retirements are paid,how could someone get you something more?

anyhow,why dont you approach the personnel dept of MCD for the detail source of such further payment if any?

You query is vague. You have not specified as to how the deceased was related to you and what dues have actually been paid? The entitlements of MCD employees are at par with Central Govt. Read a very short book which is called Swamy's handbook by P Muthuswamy publications from Chennai. It is available at all book shops selling govt rules. (I am not advertising anyone's sale) This book gives details of all entitlements of past presennt and future Govt emplyees including dead one. You can see if any benefit is left out. If the amount is worth it then go for litigation. MCD is now in the jurisdication of CAT.
