a is deposite a chek in bank, the check is bounse endorsment is NO SUCH ACCOUNT now the a is entitiled to recover the amount of cheque by N I act 138, or any other remedy for that.

First you have to prove from where the custody of cheque has come to you and what was the liability.

if you want to recover the money mean you have to go with civil procedures for recover your money. [if the cheque is genuine one]

was it in discharge of debt due and payable?

if accused does not have any account in the bank how did he get his hands on cheque book ?
