Under what provision of law a father can file a petition for either visiting rights /
custody of a child

Is the marriage subsisting or divorce has taken place ??

if there is decree of divorce if any order for custody of child passeed by court while decreeing the divorce???

If yes ! then reason for seeking custody???

are you facing a real live situation or just making hypothesis?????????????/.

Prabhakar Singh Sir, it is real live situation, the divorce petition is pending. the Husband would like to get an order for visiting rights to see his son on weekly basis.

You can apply under HMA 26.

You can also file a seperate suit under Guardian and Wards Act, 1890.
