Trust deed query

Dear Expert,

Kindly advice me.

We have employee welfare fund formed from last 4 years.

we hav pan number also.

no Trust deed is prepared yet.
we need to prepare a trust deed for claiming exemption u/s 10

can we prepare a trust deed of current date?

Yes you can execute trust deed and it shall have to incorporate the appropriate clauses in the Trust Deed

Format of Trust deed is ready with all clauses and objectives.

only issue is can we made it on current date mentioning formation of the trust four years back........

But it is private or public trust.

it is a trust established for employee welfare.
monthly contribution from employee salary goes to fund.
it is utilised for benefits of employee.
extra income is invested in Bank FDs.
it is a type of private trust.
need trust deed for exemption in taxation

1. Trust would be formed from the date of incorporation and registeration.

2. Only after registration you can get exemption.

3. Past funds can be directly transferred to the registered trust by agreement amongst trustees.
