Hi I am advocate but I am practicing in Property related Sale deed and Document work.I have given Legal Notice for my Client in Cheque return case hence I wan to know Court room legal procedure in 138 negotiable instrument.

if you are not familiar get your complaint under section 138 Ni drfated by lawyer who has some experience in 138 matters . the reason being in the vent you fail to draft complaint properly the accused may be acquitteed and your complaint dismissed .

after filing of complaint the case appears on board for verification ,. if magistarte is satisfied that all ingredients of offence are made out after verification of original docuements summons are issued to accused to appear on date fixed . summons have to be served to accused .plea is recorded on accused filing his appearnce .

Yes!Mr.Sethi is right.The case you are handling is a bit technical and it is desirable for you in the interest of your client as well as for your own reputation to get in touch of an experienced lawyer who can comfortably deal it.

Take help of local lawyer dealing in such case as it is not possible o obtain online guidance for practical work.
