Crpc 91

Hi

Please let whether below document can be requested through crpc 91.

1) Document from hospital where husband and wife went for consuelling.
2) Mobile Call details of wife phone.
3) Details of ticket booked by wife parents..

I would requires these to prove my defence. can crpc 91 be used for third party service provider, ie doctor,phone company and travel agent.

Yes and No.

CrPC 91 can be filed, if you want to prove something material by a document, which is in the possession of a third party.

Hence whether you can summon these records would depend upon what facts you want to elicit.

Supposedly, A says A&B went to place X and blah blah blah happened

B counters and says, Blah Blah Blah didnot happen.

Just proving that A & B went to place X is not sufficient.

The material thing before court is the proof of "Blah Blah Blah" and not your visit to place X. Visiting place X doesnot prove anything.

Response shonee sir,

1) Husband and wife went to doctor for consuelling, file contain discussion which couple had with doctor to resolve their issue. That was last day they met, latter divorce was filed based curelty and dowry harrasment which is not true.

Husband already have audio recording of conversation handy, but he want to add evidence using neutal witness.

2) Phone bill is required to prove simething else, but i dnt her phone bill.

3) require ticket detail to prove , visit was pre planned and not due sudden dowry demand and forcing girl to her native home as claimed in divorce and police complaint.

The said documents can be asked to be produced u/s 91 Cr.P. as the same are not privileged documents.
