(Querist) 03 April 2009 This query is : Resolved
Dear Legal Fraternities,

I am the new member of this Club. It is a good opportunity to learn new things & clarify doubts about legal issues.

With reference to the subject, can any individual eligible for double employment as per law? (i.e. one job in government & other is private organisation or insurance agencies?

Waiting for your positive reply.

No. Govt., employee cannot do either business or any other job, but he can do agencies in the name of relatives or brothers or wife etc.,but once it is revealed that govt., employee is doing in others name it is harmful to him.

Such prohibition of double employment comes from the terms of employment whether Government or Private. An employment letter in private sector invariably provides that the would be employee shall not take any other employment part or full time while in service of that employer. Government rules expressly prohibits double employment.
Mr. Sanjeev Desai there is no provision as such in any labour law prohibiting double employment. It is only terms of employment which prevail.

Prasadji,
Govt service is such that you will require a permission even to write a book and publish in leisure time at your home( office off time). For the details you can go through conduct rules(dos & donts)in 'Swamy's handbook',available in almost all major book stalls.Even for agency like, you would definitely need written permission of the appointing authority.

Generally prohibited but depends upon the terms and conditions of the job.

Now-a-days Govt. is also hiring on contract basis. In such circumstances the terms and conditions are to be seen.
