(Querist) 16 August 2011 This query is : Resolved

Is a property subject to a private trust capable of being alienated? If, so who is competent to transfer the property? What are the issues of concern to the buyer? Would our experts share their expertise?

the owner of the trust property have rights to sell, once again check with which type of trust made out then buy it.

Generally trust properties are not alienable,in certain very sounding grounds court of district judge may permit a sale or long term lease.A buyer should first check the trust deed itself then if the defacto trustee is found appointed lawfully as dejure
too,the buyer should ask him to apply for permission which if granted the buyer can buy as per terms of permission.

I do agree with the opinion of Mr. Singh.
