daughter right in father and mother property

sir,

my grand father has the property which is acquired after his father's death(agricultural lands ).
my grand father has 2 sons and 1 daughter.
my grand mother also has some property of her own(agricultural lands,sites,houses) .

now both the sons alive ,but the daughter is died, i am the son of the daughter ,who was died ,

does i have any right in the above properties of my materal grand father and materal grand mother).

can i go court in this regard.

Dear S. Santhoshkumar,

absolutely you have 1/3 share in that properties of Grand father and Mother, After the dimese of yor mom you are become class I heir as per hindu successsion.

So seek a parttion of that properties between your family otherwise file a partition suit in jurisdictional Court.

Of course you can get the share, which your mother got, if she is alive

Since it was ancestral property, daughters have equal right on it.

yes, you will have an interest as well as right, in the maternal grand parents property, if it was not disposed to anybody.

You can file a Partition Suit for your share as you are eligible for the same.
