Can a person in JC be present in High Court during his case hearing?

Querist : Anonymous (Querist) 13 June 2011 This query is : Resolved
Hi Expert,

My father is in JC in a case since last 9 months. He wants that he should be present in the Delhi High Court during his case hearing.
1.) Is there any law,any rule of CRPC which says that the person in JC can be present in court? If yes then what are the procedures.

2.) Can he also argue on his case in High Court as well?

If he does not wish to engage a lawyer, he should inform the HC in writing that he does not want to engage lawyer and that he will himself argue out the matter. The HC will call him to the Court to hear Arguments.

But he has a lawyer for High Court. In that case, court will not allow him to attend the hearing if he wants?

He wants to argue himself. Hence, he can request the HC to hear him instead of Lawyer.Such a permission can be granted.
