Querist : Anonymous (Querist) 30 May 2011 This query is : Resolved 
A Will was registered by a Scheduled caste candidate in favour of the upper cast candidate in the year 1979. In State of U.P. in the U.P.Z.A. & L.R. Act it was inserted in the Section 167 & 157-A in the year 1981 which was effected w.e.f. 30.06.1981, The Executor of Will died in the year 1987 and the person claimed the benefit of WILL in the year 1990. Whether the Sec. under Z.A. Act is benefited to the testator or what position of WILL which has already been executed prior to amendment Whether any Law in this regard or any citation/

I think no citation required as the amendment being prospective in nature.

Any amendment to any law cannot be affected from back date unless specificly mentioned in the amendment. So, the benefit of the will could not have been denied to the person in whose favour the will was made.
