Shop not vacated

I am poor widow lady.I owned a house and a shop.On 1 Dec.2010 A local Medical Dealer requested me to give me my shop for few days till he arrange his shop.He also applied for obtaining licence for sale of Medicine and obtained the same.No Rent deed has been executed so far.He has not paid any rent so far.
Few days later I request him to vacate my shop.But they refused to vacate the same.I report the matter to the Police but all in vain as they are influencial person.Pls guide me what shall I do know to vacate my shop.

Please indicate (i) where (in which city) the shop is situated,(ii) whether the occupier is paying any amount to you, (iii) what the police has reported on your complaint, and (iv) whether you have signed any document for the occupier getting of licence for sale of medicine.

YOU MAY ISSUE A LEGAL NOTICE TO THE SAID PERSON AND THEN FILE A CIVIL COURT MATTER FOR EVICTING THE SAID SHOP UNDER THE RENT CONTROL ACT.GOOD LUCK.

First you send a Notice U./Section 441 of the Indian Penal Code and mention that - The Person entered Unlawfully in Your Property i.e. Your shop , unlawfully remains there with the intention of taking unauthorized possession of such Property and he annoy with you , when called upon to do so by that person by notice in writing duly served upon him by the date specified in the Notice after that even if that person not vacate your Shop then You should file a Police Compliant U/Section 441 of the Indian Penal Code which is cognizable , it means Police Arrest that person without warrant of The Magistrate Under section 447 of the I.P.C.and even Police not taking any action against that Person You File a Criminal Complaint Under this Section In the Court- and Magistrate will order to Arrest that Person and matter decide in your favour as per Criminal Proceeding.

story can not be that easy that lady parted with the shop for a song. Now go to legal system and it will take time , money and efforts.

Eviction petition can be filed either in the Rent Controller court or Civil Court.

First of all get the original licence back, if not in your possession. If he declines to return the licence get that cancelled from the deopartment concerned stating that some unathorised person has taken by force and misusing the same.

Therafter lodge a compaint with the drug inspector as well as the police about illegal pharmaceutical business.

However, if you don't want to lose the license. file a case of eviction petition with the Rent Contrller with the help of some adocate.
