COMPLAINT AGAINST INDIVIDUAL WITH CRIMINAL CASE

1. What action can be initiated against a central government/State government employee by his own department, when it is informed to them that the said employee has a criminal case pending against him. I have informed the state government concerned (disciplinary action Department)about my previous tenant against whom a criminal case under section 138 NIA is pending.

i think its personal issue, so you could not complaint, same time his case will convicted at the time you may make complaint at his higher officials.

The Department cannot take any action. The matter is between you, the government servant in his private capacity and the court which is to deal with the matter u/s. 138 N.I. Act.
The Department would have simply filed your complaint, since they have no action to take on the same.

The department will not take any action as it is not any criminal fir case in which the investigation is on process and he may intrept the ainvesrtigation due to his influance or post .
The filed case is a complaint case and the court is investigating it by his self. So no action will be taken by employer against him.
