Querist : Anonymous (Querist) 20 February 2011 This query is : Resolved
How to get my own family case related Exparte Cerified Decree from Other State Civil Court without taking help or service of any Lawyer of that state?

Can I send an application under RTI act?

If you are a party to the said decree, you can file application for issuance of certified copies by submitting copy application forms affixing requisite stamps of the concerned state. You cannot apply for the judicial orders under the Right to Information Act. If you are a third party, you have to file an affidavit showing your interest for obtaining the certified copy along with the copy application form. The judge concerned after satisfying your claim, will order for issuance of the certified copies. Right to Information Act is not applicable to judicial orders.

The papers on the file of a decided court case are public documents and any person whether or not a party to the case, can obtain certified copy of any such document.

There is no need to avail the services of a lawyer for obtaining certified copy of a decree. You may make an application through post on prescribed proforma by affixing stamps towards payment of the requisite fee.
Advocate. Arunagiri (Expert) 22 February 2011
You have file the copy application in the respective court.
