Court marriage

(Querist) 03 February 2011 This query is : Resolved 
Dear Experts,

Often we can hear the words "court-marriage" either in movies or on TV and even from some people also.

Since only way to marry is to solemnize the marriage according to one's custom and also get it registered before the Registrar of marriages,then

1.What does "court-marriage" mean?
2.Or is it just a misconception?

USUALLY THE WORD "COURT MARRIAGE" IS MEANT FOR MARRIAGE REGISTERED IN THE OFFICE OF REGISTRAR OF MARRIAGE.

court marriage means, marriage before the (district)marriage officer according to the special marriage act.

no. I TOTALLY DIS AGREE WITH OUR LEARNED EXPERTS.
i think, court marriage means something else......because , in the above instances, only marriage registrars are involved, and , no courts.
court marriage means, when a boy and a girl are in love and either one is wrongfully confined by his or her parents or guardian, the other party can move apetition u/s 98 of CRPC stating that a particular person is wrongfully confined and the court will send a notice to that person's parent to produce him or her and will ask with whom she or he would like to go ?( if she or he is a major ).
he or she can chose either the parents or his or her life partner. and the court will pass an order according to the wish of the person alleged to be confined.
and from the date of judgement of this magistrate court, they can live together without the intervention of their parents.
this is generaaly, termed as "court marriages ".
habeous corpus petitions in high courts are synonimous to this .

applications u/s. 98 of Cr.P.C. are maintainable before Magistrates and Magistrate have no authority to solemnize a marriage.
Court Marriage means Marriage under the provisions of Special Marriages Act only!
