Partition Suit

Querist : Anonymous (Querist) 30 December 2010 This query is : Resolved 
A simple partition suit filed by the daughters seeking equal share in their father's property is pending in the district court in Tamil Nadu for more than 5 years. Does it require more than 5 years to resolve the dispute of partition ? I really wonder. Can any learned expert suggest solution for bringing an early end to the suit ?

The various stages involved in a proceeding need to be passed through without seeking adjournments. If advocates on both sides are co-operative the case could go through fast otherwise the case would drag on endlessly. There are instances of cases initiated about 15 years back are still under progress.

If both the advocates are co-operative, the could in its normal course be completed in about two years time. However, if you feel the otherside is dragging on the case on flimsy grounds, you may approach High Court for speedy disposal of the case when the High Court would fix a period for its completion.
