deductions for reducing interim maintenance

Querist : Anonymous (Querist) 04 November 2010 This query is : Resolved
Dear Experts

if husband shows too many deductions in the form of personal loans etc. how the interim maintenance would be decided? Often it has been seen that many men manipulate to lower their incomes to a very ridiculous extent, like reducing the income of 60,000 per month to 14000 by showing too many deductions. In that case how interim maintenance for wife and chid/ren would be decided?

If the deductions are proved to be frivolous, then the court can grant substantial maintenance.

No.The court takes into account the income of the husband not the deductions towards various loan he may have taken. By taking several loans for his own safety and luxury, the husband can not avoids the amount of maintenance, his wife deserves as per his status.

An able bodied person can not deny to maintain his dependents as per the standard of living maintained all along.
