Extension of notice period

Querist : Anonymous (Querist) 03 November 2010 This query is : Resolved 
My son is an employee of a reputed IT company in Mumbai. Due to some of his personal committment he has submitted his resignation (Notice of two months)and presently on notice period (this is as per the policy of the company). Now his superior says that he has to work one more month after expiry of the notice period of two months. Can the company extend the notice poeriod ? If no, then what action can be taken against the company. My son is not willing to continue after expiry of notice period. Reply is awaited. Regards.

it depends upon terms and conditions mentioned in letter of joining

It cannot be extended. The company will be committing a breach of contract if such extension is made.
