Employment of women after 7 P.M

(Querist) 16 October 2008 This query is : Resolved 
We are textile company we are having majority of women workers due to tight schedule we are engaging women workers after 7 P.M Is this Legal?
What happened to Sec.66 (1) (B) of The Factories Act 1948.
Whether we employ women workers after 7 P.M
We are running one shift only the timings are 9.30 A.M TO 6.30P.M

Sec.66 of Factories Act,1948 prohibits employment of women in factories between 7.00pm and 6.00am.The State Govts.have the power to vary the time limits.The Factories Act now allows women to work night shifts.Two High Courts have struck down sec 66(1)b.Total working hours should not exeed 60 in a week and the total overtime hours should not exceed 50 in a quarter(Textile/Garments).Any worker working for more than the maximum prescribed time is entitled to wages in respect to such overtime work at twice the ordinary rate of wages.
