You can file a case for Divorce by way of filing a counter claim seeking divorce from your husband on the ground CRUELTY.

Maintenance / Permanent Alimony is different

Your question is confusing. What is the need to get a second divorce if your Husband has already obtained one? U want to separate & the court has granted permanent separation thru divorce albeit ex-parte.
As for permanent alimony, U can always approach the court & demand return of your belongings & permanent alimony while accepting the divorce.
