sir my uncle has a comercial shop in delhi which was let out.

there is a proper agreement for letting out of property.

but the tenant is not paying the rent from last many months nor he is coming to the shop. even the cheque was bounced given by him.

the shop was locked from outside with his goods.

my uncle want to take the possesion of the shop.

what can my uncle do if tenant do not reply to him in any way...

what is the legal procedure for the same?????

File eviction proceedings against the tenant for wilful default of payment of rent for more than 6 months after giving notice.

Give notice to your tenant's residence address demanding rent. If he is paying the rent even after the notice. Even if he refuses to receive the notice, File a RCOP case for eviction. The court will order for payment of rent in its interim order. If the tenant fails to pay the rent even after the court order, the court will order for eviction. The eviction order can be executed with court staff and you will get your possession.

ARUNGIRI SIR what is RCOP and cant we take the possesion without the order?????.

and sir how much time will it take if we follow the proceeding????????
