Madras high court CMP case delay

(Querist) 23 August 2010 This query is : Resolved
Dear Sir/Madam,
My case no CMP.27/2010 is pending in high court for past 7 months. Its a divorce transfer case put by my wife. My advocate says the case is not comming up for proceedings. It looks like my wife side they are delaying it intensionally.

1. Is there any way to know the status of the case. The websites http://www.courtnic.nic.in/chennai/content.asp says the case is pending and in http://causelists.nic.in/chennai_new/index1.html its not getting listed.
I would like to know if there is any way to know, when the case can be put up. By walking into the court or by meeting any person.
2. Is there any way to close this transfer case quickly. I am fine even if it gets transferred to Trichy(even though there is risk to my life). I want the divorce case to get started as soon as possible. Please let me know if there is any way to get it done.
Would kindly request to quide me on this.

yours sinserely, Siva.

You problem will be solved quickly if you instruct your advocate positively to get the natter listed after ,asking mentioning in the court and get that heard. One the case is listed the other side would not delay the matter anymore.

You can approcah the Information Centre in High court of Madras Premises to know about the status of your case. It is done free of cost. If you want a print out of the status a meagre sum of Rs.5 is charged. You can request your lawyer to make a mention about the urgency in the matter to the concerned judge and seek listing of the matter.

High Courts are the Lousiest Places as far as Transfer Petitions or Misc Petitions are concerned they are good only for WRIT Petitions , Here the Registrars Judiciary who is responsible for Listing activities and completely corrupted so try your Luck in that direction.

Direct your counsel to make arrangement for getting it for listed as early as possible
