conversion of family trust to charitable trust/organisation

(Querist) 10 August 2010 This query is : Resolved
my client is having a registered trust governed by Indian trust act.all the trustees except one are family members. Now they are interested in converting it to fully charitable trust dedicated to computer literacy purposes. Can you pl. advise as to what changes in the deed shall be required to change the objective of the trust? will it affect the date of formation of the existing trust? further advise as to what should be done to give the trust national validity?

You havt mentioned the present status of the trust except that it is a registered trust. If the trust is not a charitable trust then you can incorporate/add further objectives in the trust including the charitable purposes by passing resolutions in the meeting of the trustees as per the trust deed. Regarding national validity every trust deed is valid nationally unless and otherwise there is a restriction clause in the trust deed which may be altered.

I will just add to Mr Rangnathan that after passing the resolution you have to apply to the charity commissioner for amendment of the original objectives OF YOUR TRUST .

Do activities and what national you can get international status.

GO AHEAD AND DO IT.
