Whether Foreign Expats and contract employees are included in the count of twenty employees required for coverage of an establishment under Employees Provident Fund Act and Employee State Insurance Act ?

Further if a company comes within the epf act at a back date but comes to know of its applicability on them now. Then in that case what is the proper recourse? Should we start the compliance procedure now ? and if yes then with some default penalties ? Please elaborate ?
