Rajesh Kumar (Expert) 11 September 2008
Legal entity if a difficult term to define. In fact every association of persons may be treated as a legal entity.
To be specific, a trade union exist even without registration (look at the definition of trade union). What is registered is an existing trade union, trade union doesnot comes into existence on registration. Off course on registration certain immunity is conferred on the TU, which may not be available to unregistered trade union.
A deregistered trade union doesnt have immunities, but coninues to have all other rights of a trade union, including rights of an association of persons.
A complaint by deristered trade union is not void.
