Banker has returned the cheque with instructions to present it again. wheather it is bouncing of cheque and the the Bank is liable for damages. Any case law in support of the bank.
I have to protect the banker in a law suit on the plea that the return of the cheque for presentation again is not the bouncing of the cheque and the Bank is not liable to the damages on this count

No, it is not bouncing for the provisions of 138 / N.I.Act; You may take the Bank to task for such mishandling and thereby delaying the payment on first presentation !

I fully agree with Mr.Singal. U may sue the bank for damages preferably in a consumer court.
