Dear Abcdef,

Under Art. 132 of the Constitution of India, an appeal can be preferred before the Supreme Court, against the decision of the High Court only if it involves substantial question of law as to the interpretation of Constitution of India. Even this appeal can be preferred ONLY when the High Court has granted a Certificate stating that the issue raises substantial question of law relating to the interpretation of the Constitution.

Without this certificate from the High Court one cannot prefer an appeal before the SC.

Similarly, under Art.132 also, an appeal can be preferred before the SC only if the High Court certifies that the matter needs to be decided by the SC.

But notwithstanding these restrictions, the Supreme Court has discretion under Article 136 to entertain any Appeal against the decision of the high Court. For this, Supreme Court has to first grant a special leave agreeing to exercise its discretion, and to hear the appeal.

That is why it is called 'special leave petition'.

Then i may be allowed to add that SLP lies not only against HIGH COURT'S JUDGEMENT but
against all Tribunals/forums/commissions' judgments(civil or criminal) which have achieved finality.
