Solicitor and advocates difference

Querist : Anonymous (Querist) 31 December 2011 This query is : Resolved
SIR WHAT IS THE DIFFERECE BETWEEN SOLICITOR AND ADVOCATE. WE FREQUENTLY READ IN PAPERS THE PHRASES "ADVOCATE GENERAL" AND "SOLICITOR GGENERAL"
A V Vishal (Expert) 31 December 2011
Solicitors advise clients and draft pleadings/documents, but engage advocates for conducting the case in the court. Lawyers who want to be solicitors should pass an examination. In India, such an examination is conducted by the Bombay High Court only.

He can cover large clientele unlike the advocate, Mostly solicitors work om retainer basis gor large companies for a handsome remuneration.

Commercial clients call in solicitors for advice on matters including litigation, property, tax and finance. Private client work usually involves personal legal matters such as wills, property conveyancing, divorce and custody. Solicitors' firms come in all shapes and sizes so it’s important to do your research first and find out which one would suit you.

Solicitors need a wide range of skills. As well as being able to communicate with clients and develop good working relationships with them, they need to be able to work closely with colleagues, pay close attention to detail and be willing to work long hours. They also need initiative and good judgment to work with complex information.

A two-year practice is also required before an Indian lawyer can qualify as a solicitor.

The attorney general of India is the Indian government's chief legal advisor, and its primary lawyer in dealing with the Supreme Court of India. The attorney general is usually a highly respected senior advocate of the court, and is appointed by the ruling government.

The office of the attorney general was created by the Constitution of India, and attorney generals have the right to participate in the proceedings of Parliament, but cannot vote.

Unlike the United States, in India, the attorney general does not have executive authority and is not a government minister; those functions are performed by the law minister.

The attorney general is assisted by the solicitor general of India and several additional solicitors general. The solicitor general is the second law officer of the state after the attorney general. Unlike the Attorney General, Solicitor General does not tender legal advice to the Government of India. His workload is confined to appear in courts on behalf of the Union of India.

According to wikipedia, advocate is another word for barrister, which means a lawyer (attorney) who is allowed to present a case in court, as opposed to a solicitor, who is an attorney that works directly with the client but does not represent him/her in court. I believe the distinction between barristers and solicitors is specific to common law systems, like that in Great Britain. We don't have that distinction in the U.S. If you're admitted to the bar (meaning you have a licence to practice law), you can appear in court.

Rightly advised by Mr. Vishal and Mr. Rajkumar
