Remedy for delaying the possession or exceeding the time of possession by a builder

Dear Sir,

I have purchased a residential plot offered by Vatika Group in 2005 in Jaipur and paid 95% of the agreement value by August 2006. The company sent a buyer agreement for signing in October 2007, which I signed in compulsion after going through the contents I found the same one sided, but I have no option but to sign otherwise, the builder would deduct 25% of the paid amount. I suffered due to paying the installments in advance, while they have changed my plot number, and now wanting me to approve the same. I felt cheated as they have done it through a legal document but fraudulently.
I now want them to return the money with interest as still they have not received any approval, neither they have shown us any approved plan.

Though several legal recourses are available to you but keepiing time and cost involved I think you should go for complaint u/s 12 of the Consumer Protecton Act before the concerned Consumer Forum.

Company/Builder has cheated you by adopting unfare trade practice so file a complaint against company/builder u/s 12 of Consumer Protection Act before District Consumer Redressal Fourm.

First issue notice to the builder to allot the same which was allotted to you, and also informed the builder that you have been cheated by him and his act amounts to unfair trade practice.
If he replied and allot the same then no problem otherwise file a consumer complaint.

Please issue a statutory notice to the builder and after expiry of 3 or 4 weeks, file a complaint before the concerned District Consumer Disputes Redressal Forum if your claim is less than 20 lakhs.
If the claim is above 20 Lakhs to Rs. 1 crore , you will have to file the complaint before the State Consumer Disputes Redressal Commission.
