Thirty years back my father died before my birth. Around fifteen years back his three brothers’s distributed the house and shops equally with some share for his mother. I and my mother were not given a single penny. My grandmother and three uncles earned lot of money from the property of one house and three shops. Also there was another commercial plot owned by my grandfather, of which no one knows what happened to the plot. Kindly tell me that (1) how I can receive (under which laws) my share with the share of money made by my share in last thirty years? (2). Is there a criminal law that can put my grandmother and three uncles behind bar for the injustice they have done to me and my mother and the relative who enjoyed my share without my notice for thirty years.

You are entitled to 1/5th share in the properties of your grandfather whether ancestral or self acquired. You may file a suit along with your mother for partition of all the residential & commercial property and rendition of accounts for the profits made on those properties for which even you are entitled for a share, however, technically you face a bar on account of limitation since a long period has elapsed, you may send a legal notice first and then proceed based on the reply of the same.

Mr. AV vishal is right but i want some amendment in the suggestion.In this case there is no limitation to file suit for partition and account.

go for suit for general partition and separate possession. You can also pray for meanse profit.

u will get share.first u have some papers viz. death certi.of ur grandfather,and ur father,alongwith sucession certificate,with that enter your names in ROR though the property is sold out apply for that also.for detail procedure call 9422773303
