How can i share my fathers self earned property

Sir, my father has three houses in madurai city, all the three houses were purchase by my fathers self earned money and the houses are in my fathers name. My father has three sons including me, and am a physically disabled person and not yet married.. I have two elder brothers and both are married and my first elder brother has three sons and my second elder brother has 1 son and 1 daughter.. My father is 66 years old and still now he doesnt made any will. My brothers are living separately with their wife and childs in my fathers house and i am living with my father.. After my father, and if there is no will a). how can we (at what ratio) share my fathers properties? Do my brothes sons(all are above 18 years of age) have share in my fathers self earned properties? C.) my father sold out his ancestrol property before 15 years, does this affect sharing or selling his self earned properties by my father?.

Everybody is entittle for equal share in the properties with your mother.

Your brothers' sons have no share in the property. All the 3 brothers are entitled to 1/3rd share each.

Father can distribute his self acquired property as per his wish during life time. After him , in absence of any will, the property would be distributed equally among three sons and mother.

The share of father in ancestral property will be further distributed among his legal heirs.

You have not mentioned about your mother and grand-mother who shall also get equal share in the properties left by your father intestate. The children of your brothers shall not get any right in those properties.

Thanks, raj kumar sir, my grand mother was nt alive.. My father already purchased one house in the name of my mother sir.

Yeah, she is alive.. But my father already gave a house to my mother, he transfered one house in the name of my mother.

Nobody can share your 66 years old father's self earned property when he is still alive. If no will is made, after his death irrespective of your mother having already been given a house by your father, your mother along with all of her three sons (you and your brothers) would share the property equally.
