sir, a old mother deserted from her son want to get maintainance from her son but she even can not go the court as she is suffering from pyaralysis.... in that situation can she file a claim by her naighbour by way of unregistered power of attorney.... in else what is the proceedure.... please suggest me...

She can get in touch with NGO and pray for maintenance from Senior Citizens Maintenance TRIBUNAL.
It does not need any advocate.

any other person can file the domestic violence case on behalf of the old lady against her son and not only demand maintenance she is entitled to get accomodation, medicine cloths too.
file a domestic violence case under section 12 of the DV Act.

All District has Protection Officer appointed for DV sec 12,
He being welfare office, have right to take complaint, can visit her home, and file DV.
contact him [ most probably in collector's office]
he will file DIR Domestic Incident Report.
[also read sec 5 of PWDV Act. + sec 9 " Duties and functions of Protection Officers :: to make a domestic incident report to the magistrate/ to make an application... to magistrate..
OR
Draft DV Application, get it NOTARY. get her VP, and file c JMFC.
it will be entertained and heard.
OR
Local Police is duty bound, under DV, to do needful, arranging visit of Protection officer, and file DV, on her behalf.

There are many other similar and more serious issues but still this website is fulfilling a very imp and useful purpose.
ANOTHER MOST IMP SIDE EFFECT AND ADVANTAGE IS THAT IN THE PROCESS CHAFF CAN BE SEEN SEPARATE FROM GRAIN.
SO LET THE PEOPLE BE HAPPY WITH POINTS SINCE THEY PROVIDE YOU A PLATFORM TO BE SEEN EXCLUSIVE.

The learned expert Mr. Shroff though is trying to express his anguish over the way some experts behave here, my question is what difference it makes, why should we point out somebody's performance, is it going reduce your points or whether you will be awarded with extra points for discovering such facts and informing them to all others.

She can get relief through S. 125 cr.p.c. or DV Act or through Senior citizen's Act. My advice is that she can approach u/s 125 cr.p.c. instead of other two Acts for various reasons which cannot be explained in this column. In these cases her neighbour as a next friend can file petition on her behalf. At the time of evidence as she is paralytic, A court commissioner can be appointed to take her evidence. Pl. do not forget to file interim application also. In addition to this, if she crossed the age of 60, take necessary steps to get govt. pension also for senior citizens, which is available in the most of the States. In the metropolitan cities, the old age homes are run by State Govt. and NGOs at free of cost to indigent persons. Try to get accommodation to her in any of those old age homes. Our replies/ Answers must be helpful to Querist. THE Whole World Look at us, hope from us for the legal help.
Its irritation, seeing every day same rubber stamps...non helping, few words , against the aim and objective of LCI.
Top expert must try to help Querist, add few informations , Maintain the Dignity of Experts.
I appreciate Adv Defense saying

But the Question is
why we should have CHAFF, EMPTIES HERE?? ?It only spread dust and rubbish. It occupy space too. It waste time too..
It tarnish the image of EXPERTS. IT IS A TEAM..

WE ALWAYS WANT TO BUILT A BRIGHT LCI EXPERT TEAM.
