Completion of BTECH course during probation period

(Querist) 17 October 2016 This query is : Resolved
Sir I am b.tech final year student. I got job on Diploma basis as TPBO by direct recruitment by TSPSC. I have joined the duty on 06-09-2016. As I am in final year, I am very much interested to complete my course. Is there any provision to take leave in probation period for my education? What type of leave can be granted? Can you please tell me the rule which is applicable for this leave? By whom the permission is to be granted for the leave? For how much duration the leave can be taken?
Rajendra K Goyal (Expert) 17 October 2016
You can forward the application to competent authority through your departmental head. Send one direct copy.

Clearly give the consent that you would follow department directives.

Leave most probably would be without pay and your seniority and probation can shift.

Go through leave rules of your concern.
Rajendra K Goyal (Expert) 17 October 2016
It is supposed you have mentioned regarding your present course while submitting form for this job.
Guest (Expert) 17 October 2016
No service rules permit regular course along with service. You may have to forget one thing out of the two, the service or the B.Tech final year course.
Ms.Usha Kapoor (Expert) 18 October 2016
Agree with Mr.RK.Goyal.
malipeddi jaggarao (Expert) 18 October 2016
Agreed with Mr.Dhingra.

Even if mentioned regarding your present course in the application for job, still you would not be allowed by the employer to continue with any regular course along with service.

A matter of commonsense, how can you justify attending office duty and the course in a college together at the same time? You are recruited by any employer for getting office jobs accomplished, not to pay you for attending your academic courses or fulfill your other career ambitions.
Kumar Doab (Expert) 18 October 2016
The employer may extend the notice period by proportionate days of leave.

Convince the authorities.

Download the service rules and relate.
Rajendra K Goyal (Expert) 18 October 2016
Even than there is no harm in approaching and applying.
Kumar Doab (Expert) 18 October 2016
Employee should develop rapport, goodwill, and apply skills to convince the authority.

Apply seek and get the approval.
Sudhir Kumar, Advocate (Expert) 18 October 2016
I am sorry.

I hold entirely different vews.

Regular course can be permitted ruing service provided :-

(i) deptt allows so

and

(ii) deptt is willing to grant admissible leave.

if any of the conditions is absent then view of Mr Dhingra hld good and you have to forget and forgo either course of job.

Sudhir Kumar, Advocate (Expert) 18 October 2016
Further leave if granted will be without pay as expressed by Mr Goyal.

But there is no provision to extent probation or shift seniority if someone is on sanctioned leave even if unpaid.

If you submit notice of resignation then the notice period can be covered by sanctioned leave there is no rule against the same.
Sudhir Kumar, Advocate (Expert) 18 October 2016
Further be enlightened.

Whether you apply for leave or not, it is a departmental misconduct to continue study without permission of the deptt.
Sudhir Kumar, Advocate (Expert) 18 October 2016
you asked

Is there any provision to take leave in probation period for my education? What type of leave can be granted? Can you please tell me the rule which is applicable for this leave? By whom the permission is to be granted for the leave? For how much duration the leave can be taken?

ALL THESE QUESTIONS ARE NOT OF LEGAL NATURE. EVEN A UDC OF YOUR ESTABLISHMENT SECTION CAN GUIDE YOU BETTER.
Guest (Expert) 18 October 2016
On new entry in job, no leave becomes due. Moreover, at the very start of job, nobody would allow the employee even for a few days of leave without pay.
Sudhir Kumar, Advocate (Expert) 19 October 2016
Mr Dhingra has expressed what normally happens practically.

that is the reaosn I said

and

(ii) deptt is willing to grant admissible leave.

However, if deptt wants they can give you EOL, 8 CL of the calendar year, EL @ 1 day for each completed 11 days of service (paid not EOL)-unless TN State leave rules provide different.

Better check details from clerk/Supdt of your establishment branch dealing with your service book.
Ms.Usha Kapoor (Expert) 19 October 2016
Agree with Mr.Sudheer Kumar.
Guest (Expert) 19 October 2016
I have not expressed what normally happens. That is based as per ruling position. State Government cannot differ from from Central Government Rules. Employers recruit an employee for work, not for profit of the employees. Mr. Sudhir Kumar may like to review his reply with reference to leave rules as to how much EOL can be allowed to any temporary employee that too at the very initial stage of his service of merely one month. As per his own statement, the author has joined duty only on 06-09-2016

However, the author is free to try his luck as per the advice of Shri Sudhir Kumar.
Rajendra K Goyal (Expert) 19 October 2016
Without going in details, once again repeated that there is no harm in applying for the same through proper chennel. Position would remain as at present if refused.

Sometime interpretation of Rules differ from person to person and decision taken accordingly.
Kumar Doab (Expert) 19 October 2016
Employee should develop rapport, goodwill, and apply skills to convince the authority.

Apply on paper under proper acknowledgment, seek and get the approval.
Sudhir Kumar, Advocate (Expert) 19 October 2016
As advised by Mr Kumar Doab the employee can have good rapport and if willing the deptt can grant him EOL without pay and allowances upto 1 year (can be continuous or broken spells)

+

CL/RH for calendar years are there.

+

1 EL for each 11 days of completed service (paid not EOL). He has so far earned only 4 days of EL

But he cannot claim such leave as a matter of right.
Rajendra K Goyal (Expert) 19 October 2016
Agree with expert Sudhir kumar.
Kumar Doab (Expert) 19 October 2016
Right or NO right.

Employee should develop rapport, goodwill, and apply skills to convince the authority.

The authority shall respond.
Kumar Doab (Expert) 19 October 2016
Mr. Sudhir Kumar has added words and lines and has illustrated my post.

I don't mind at all.

Employee should know and understand the rules.

At the same time; Employee should develop rapport, goodwill, and apply skills to convince the authority.

It is a skill and a skill can be acquired.

Author look around in your office/establishment and you shall find many employees from whom you can acquire many skills.

Guest (Expert) 19 October 2016
Let the author take advantage of the advice of getting EOL for one year, if he can.

Best of luck!
