Biased behaviour of apartment welfare association

Hi Experts,
Greetings,
Our apartment welfare association has communicated that all the tenants living should pay INR500/- per month additional to the usual maintenance(INR1500). When inquired for the details, they mentioned that since your owners are not here and are not participating in the association activities this additional maintenance fee is being levied. Honestly, this doesn't sound sensible. Also, when it was brought to my house owner notice, he has rejected this proposal and advised me not to pay the additional maintenance. Ideally, the maintenance should be proportion to the size of the flat. Because, there are few duplex flats and they still pay 1500 towards the maintenance ..while there are 1BHK flats which are 500 Sqft even and they ended up paying 2000INR towards maintenance fee. When I have tried paying 1500, they have not accepted. How shall I proceed now. Appreciate, if you could advise me on this. Thanking you.

Society can not levy any penal amount for non resident members. Lodge complaint with Society.

association is asking 30%more from tenants . non occupancy charges cannot be more than 10%. you will have to move court against the association

Lodge a complaint to society and after that to registrar of societies.

This revision in maintenance charges, has to be approved by the society's AGM. Then only the office can collect that amount.
You can ask the society office to show that resolution passed by the AGM.

Hi All,
My sincere thanks to one and all for your swift response. Specific to the point raised by Mr Arunagiri, yes they had an Annual General body meeting held in February where in they have decided about this and communicated to owners and tenants of the apartment. However, this proposal was rejected by two owners and there was no response provided to them. Also, when I have inquired with few other tenants, they were not aware of the details and have just paid the new maintenance fee, assuming its same across the apartment. Is there not a law/regulation that demands and ensures consideration of tenants opinion as well in making some association rules like this?
