dear sir some gunda forcibly taken wrong signature on 2 cheques from now they a case against me i already filled criminal on them i went to dcp and cp also nothing was they nt taking any action pls suggest me how come out from this case

File a private complaint in the court against those persons. Contest the NI act case you have got good defense.

If the police is sitting idle on your complaint then you can file petition in the court of the Magistrate u/s 156(3)crpc so that the Magistrate pass necessary direction to the concerned police official to make necessary investigation.

Whether no notice was served on you before filing of complaint under section 138 N.I. Act and if served whether you have not replied the same raising all the contentions?
If you have duly replied the notice, you may contest the case under section 138 of the N. I. Act on the ground that there was no legally enforceable debt or liability.

first of all you must lodge FIR to the police or send the complain to the police or concerned police station by registered post then proceed to the court.

Indhra, please file a complaint before the police get it acknowledged or get temporary receipt. Send a notice to your banker enclosing the police complaint copy. This will protect you from any 138 case.
