(Querist) 29 December 2014 This query is : Resolved
Hello sir,
I am Mukul Anand a railway employee. I had been suspended in 2010 due to detention of more than 48 hrs. After i released on bail i applied to my higher authority i.e. Sr.DCM to revoke suapension. But they did not allowed. Later in 2013 i pleaded to CAT, Guwahati which subsequently verdicted in my favour. I got the true copy of the order but dont know what to do with it. And if i have to submit it to concerned authority what to write in application i mean content of application, subject etc.
Please you guys helped me before hope you would enlighten me here once again.
Thanks

Submit the order with competent authority for revoking of your suspension. The department will do it unless the high court on appeal may have stayed the order in the meantime .

What are the reliefs granted by the Hon'ble Tribunal. The authorities are required to implement the directions in the normal course. I can suggest further opinion if a copy the order is made available to the email pvenu1953@gmail.com

You might have engaged advocate for who pleaded on your behalf before CAT. Take his guidance.

If you do not know the procedure for reinstatement, you may take the help of a local lawyer, get an application drafted based on the verdict of the CAT and enclose the copy, seek reinstatement accordingly.

You have not mentioned, what is the order, for whom compliance of what has been ordered, and by which date the orders have to be complied. Due to lack of this vital information, no specific opinion can be formed.

However, based on your unspecific query containing partial facts, it can be said, if judgment is in your favour and you have been exonerated from the charge, send a copy to the competent authority with your representation to reinstate you in service.

Unless you provide copy to the concerned authority or there is no specific date in the order for compliance you cannot file a contempt.
