in our case society was first formed and soc obtained land and develop.rights and constructed and allotted flats to members. former chief prom /secy who is no longer office bearer and new committee and office bearer having got elected, is not co-operating. He has declined to give documents, records,files etc. to govt. administrator board and is facing sec. 146 proceedings by them. members have got share cert, allot letter only. for some members he has taken token money and has not begun construction till date. can these members initiate 420 under IPC against him.Is 420 bailable or non-bailable ? also in accounts we noticed that one block of funds have been given without any reason to another society. Can we treat this as embezzlement and initiate action agaist chief prom under ipc?

a few years back on the recommendations of judiciary the Registrar Delhi had referred matter to CBI for investigation of such societies which I believe were 90 in number. You can get such details under RTI from ROC.

Yes you should record minutes and breach of trust,embezzlement and lodge complaint with respective authorities.
Consult a local lawyer well versed with such matters.

Gentleman thanks for your guidance. Yes I agree i am not keeping a single thread.There are many problems and now only slowly slowly after being abandoned by the former officer bearers existing members are realizing. We are all travelling and busy with office work and all from IT field. so we are absolutely clueless about legal aspects.many lawyers also keep us going in circles - pardon please with due respect to you, you are not among these - this is our experience. each lawyer has his own process and requirements. hence as and when a point strikes any one of the members as a single point reference I have taken charge to get the same cleared from your forum. We cannot assemble one time to list out all points/issues. I therefore, humbly seek your patience.please do not tell us to consult a lawyer. Approaching forum only to seek clarity so that we are able to talk effectively to our lawyers when we meet them. please bear with me. Background :ours is thane mumbai society. society type is "members/society formed first and then land purchased by society and society itself is constructing and alloting to members".total 100 members. 4 buildings planned. surprsingly all 100 trusted the promoter blindlly coming under his sweet talk. He delivered partially and then started raising unresaonable demands and showed his true colour. we complained to registrar, who appointed administrator and then administrator after 2 years held election and appointed new office bearers. now these queries you are getting are from the new office bearers since earlier one is not-co-operating, absconding, facing civil,criminal cases. If you permit me I will put the questions one by one in separate threads basis the above background. Please help.
