Bank auction property

I have purchased a bank auction plot in hyderabad in the year 2012 through Andhra Bank, where I have original link documents for 15 years.

Now i'm planning to construct house in above said property with all the municipal approvals in place , however locals in the area are saying, plot which i have purchased was in litigation in few years back, some of his previous owners might obstruct my construction process.

Can you please help me with legal steps which I can take, if some one stops my construction process ?

File police complaint and suit for permanant and mandatory injunction through local lawyer.

You are a bonafined purchaser. Dont worry no problems will come.

To cross check for any other old litigations, obtain EC.

If you come across any problems, you can approach us with real problems.

The persons who purchase immovable properties by participating auction by the Banks will not approach this forum as they are either affluent or influenced people. No ordinary person can be a successful bidder in these auctions as all the participants form ring and eliminate the genuine people. However, since you have approached us the following are comments:

1) I suppose you might have taken all original documents including the legal opinion obtained by the Bank on the property.
2) Find out the gaps in the EC and obtain fresh EC for the gap so that you can look into the flow of title of the property.
3) You are a bonafide purchaser of the property from Bank. Any defect in title before your purchase, is the responsibility of the Bank and if really some problem arises you can fall back on the Bank for the loss you incur.
4) It is always better to earmark such properties and put a notice as regards ownership.
5) As you have all permissions/approvals for constructions, you start the activity. If any objections raised, You can show the sale letter issued by the Bank and ask them to settle their matters with the Bank.

Only OWLS have been blessed with capacity to
to hunt even when there is complete darkness
so they hunt in darkness only.

As MEN are deprived of this capacity they cant not hunt in dark.

Needless to tell lawyers come from human community.

1. As regards the auctioned property is concerned, you are its bonafied Title Holder,

2. Had any body reserved any claim on the said property, he/she should have filed application before the DRT for remedial action,

3. Relax and start construction,

4. If any body physically obstructs you, lodge a police complaint.

If you missed a bonafide inquiry,then simply because it was mortgaged to bank who must have made requisite inquiries is not going to save your skin is my view.Look into the advertisement of bank's auction where it was published 'as and where basis'.

The bonafide purchaser of a mortgaged property from a bank(who have already ensured the title)and cleared objection(s) if any, must engage a local lawyer, pay him/her fees and seek advise. The experts on this platform have already advised you sufficient and free of cost.

Your query is at a premature stage. 'If' 'when' cannot be accepted as legal problem but mere a speculative question Bankers sale mortgaged properties on as is where is basis.Therefore legal liabilities may arise after purchasing it. Better you give two paper publications in the two local news papers (including one in local vernacular)by the pen of a local Advocate addressing General Public that if any body has any claim over the property he or she may meet your Advocate with proper documents of claim within fifteen days from the date of publication failing which it will be deemed that the property is free from any liabilities whatsoever and in that event no further claim will be entertained thereafter.
